heal.abstract | Georgia, Illinois, Minnesota, and Virginia have enacted new legislation for agricultural equipment modeled after the automobile lemon laws. This legislation spells out the duty of manufacturers and authorized dealers to repair defective equipment or in instances where repair is not possible to provide a replacement vehicle or refund the purchase price. Since it is not clear that the purchase of defective new tractors is a significant problem or that purchasers are unable to secure relief under existing state commercial laws, it is not evident that these new lemon laws offer consumers any real benefits. Rather the laws place consumers, manufacturers, and dealers in adversarial roles, and the afforded protection may result in escalating costs and restricted warranty protection. | en |
